Please read carefully. These Terms include important provisions, including a binding arbitration agreement and class-action waiver in Section 16, that affect your legal rights.
1. Acceptance
These Terms of Service (“Terms”) form a binding agreement between you and Tellmarket (“Tellmarket,” “we,” “us”). By creating an account on tellmarket.app, downloading or installing the Tellmarket mobile app, or otherwise using Tellmarket (the “Service”), you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 17 years old and able to form a binding contract under the laws of your jurisdiction. You must not be located in, or a resident of, any country subject to a U.S. government embargo, and you must not be on any U.S. government list of prohibited or restricted parties. You are responsible for confirming that using the Service is lawful where you live.
3. What the Service is — and is not
Tellmarket is a market-data and analytics tool. We display public price data from prediction-market platforms (currently Kalshi and Polymarket) and send notifications when user-defined thresholds are met.
We are not a broker, exchange, dealer, money-services business, investment adviser, or financial institution. We do not place orders, hold customer funds, broker trades, custody assets, or provide financial, investment, legal, accounting, or tax advice. Nothing in the Service is a recommendation to buy, sell, or hold any position. Any action you take on Kalshi, Polymarket, or any other platform is solely your decision and your risk.
Prediction markets carry the risk of total loss. Prices, fees, liquidity, and resolutions can change rapidly and without notice. Verify all data on the underlying platform before transacting.
4. Your account
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at support@tellmarket.app if you suspect unauthorized use.
5. Subscriptions and free trial
Tellmarket offers auto-renewable Pro subscriptions on the web (tellmarket.app) processed by Stripe, and on iOS through the Apple App Store. Current options and prices are displayed at checkout.
Common to both surfaces:
- Subscriptions automatically renew at the end of each period unless you cancel before that period ends.
- We may change subscription pricing for future renewal periods. We will give you reasonable advance notice and a chance to cancel before any price increase takes effect.
- If we offer a free trial, any unused portion is forfeited when you start a paid subscription.
Web (Stripe):
- Payment is charged to the card or payment method you provide at checkout.
- You can cancel from your account page or by emailing support@tellmarket.app. Access continues until the end of the current paid period.
- Refund requests for web purchases are handled by us — email support@tellmarket.app within 14 days of a charge for a good-faith review.
iOS (Apple App Store):
- Payment is charged to your Apple ID at confirmation of purchase. The subscription renews automatically unless auto-renew is turned off at least 24 hours before the period ends.
- Manage or cancel in iOS Settings → your name → Subscriptions → Tellmarket.
- Refunds are handled by Apple at reportaproblem.apple.com. We are not able to issue refunds directly for App Store purchases.
6. Acceptable use
You agree not to:
- Scrape, crawl, harvest, mirror, frame, resell, or redistribute any part of the Service or its data.
- Reverse-engineer, decompile, disassemble, or attempt to derive source code, except where applicable law expressly permits it.
- Circumvent rate limits, paywalls, authentication, or other technical controls.
- Use the Service to violate any law, regulation, or third-party right, including the terms of Kalshi, Polymarket, or Apple.
- Interfere with the Service’s operation, probe for vulnerabilities (other than through good-faith security research notified to us in advance), or transmit malicious code.
- Use the Service to manipulate markets, coordinate trades, or engage in any activity that would be unlawful if conducted outside the Service.
- Create more than one account, share accounts, or impersonate another person or entity.
7. Intellectual property
The Service, including its software, branding, content, and data presentation, is owned by Tellmarket or its licensors and is protected by copyright, trademark, and other laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for your personal, non-commercial use, subject to these Terms. We reserve all rights not expressly granted.
8. Third-party services
The Service links to and references third-party platforms (including Kalshi and Polymarket). We do not control those platforms, are not responsible for their content, terms, availability, prices, or actions, and including a link is not an endorsement.
9. Changes to the Service
We may add, modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will use commercially reasonable efforts to keep the Service available but make no uptime guarantee.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. WE DO NOT WARRANT THAT MARKET DATA SHOWN IN THE SERVICE IS COMPLETE, CORRECT, CURRENT, OR REFLECTIVE OF EXECUTABLE PRICES.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TELLMARKET, ITS OWNERS, AND ITS SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, OR FOR LOSSES ARISING FROM POSITIONS YOU TOOK OR DECISIONS YOU MADE BASED ON THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) US$50.
Some jurisdictions do not allow certain limitations; in those jurisdictions, the limitations apply to the fullest extent permitted by law.
12. Indemnification
You will defend, indemnify, and hold harmless Tellmarket and its owners from any third-party claims, damages, losses, and costs (including reasonable attorneys’ fees) arising out of (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any law or third-party right, or (d) any positions you take on Kalshi, Polymarket, or any other platform.
13. Termination
You can stop using the Service at any time and request account deletion by emailing support@tellmarket.app. We may suspend or terminate your access immediately, with or without notice, if we believe you have violated these Terms or applicable law, or if doing so is necessary to protect the Service or other users. Sections 7, 10, 11, 12, 14, 15, 16, and 17 survive termination.
14. Apple-specific terms (iOS)
You acknowledge that these Terms are between you and Tellmarket only, not with Apple. Apple is not responsible for the Service or its content. To the extent these Terms provide for usage rules less restrictive than the Apple Media Services Terms and Conditions, the Apple terms control. In the event of a failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app to you; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claims by you or any third party relating to the Service, including product-liability, intellectual-property, or consumer-protection claims. You must comply with applicable third-party terms (including Apple’s) when using the Service. Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
15. Governing law
These Terms are governed by the laws of the State of Delaware, U.S.A., excluding its conflict-of-laws principles, and (where applicable) the U.S. Federal Arbitration Act, without regard to your country of residence. The U.N. Convention on Contracts for the International Sale of Goods does not apply.
16. Dispute resolution — arbitration and class-action waiver
Please read this section carefully. Except for disputes that qualify for small-claims court, any dispute, claim, or controversy between you and Tellmarket arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will be conducted in English, on the documents only unless either party requests an in-person hearing, and the seat of arbitration will be Wilmington, Delaware. Judgment on the award may be entered in any court of competent jurisdiction.
You and Tellmarket agree that each may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class or representative action. The arbitrator may not consolidate more than one person’s claims and may not preside over any form of representative or class proceeding.
30-day right to opt out. You may opt out of this arbitration agreement by emailing support@tellmarket.app within 30 days of first accepting these Terms with the subject line “Arbitration Opt-Out” and including your name and the email address associated with your account.
If any portion of this Section 16 is found unenforceable, that portion will be severed and the remainder will continue to apply, except that the class-action waiver is not severable; if a court finds the class-action waiver unenforceable as to a particular claim, that claim must proceed in court.
17. General
- Entire agreement. These Terms (with the Privacy Policy) are the entire agreement between you and Tellmarket about the Service and supersede prior agreements.
- Severability. If any provision is held invalid, the rest will remain in effect.
- No waiver. Our failure to enforce a right is not a waiver of that right.
- Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
- Notices. We may give notices via the app, the email associated with your account, or by posting on this page.
- Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
- Changes.We may update these Terms; the “Effective” date reflects the latest version. For material changes we will give at least 14 days’ notice through the app or by email. Continued use after changes take effect means you accept the updated Terms.
